1. Acceptance of Terms

By accessing or using the Heedb platform, website, APIs, or embeddable widget (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Heedb provides an embeddable contact widget SDK that enables businesses to collect feedback, support messages, and privacy requests from their website visitors. The Service includes a dashboard for managing submissions, AI-powered message triage, transactional email delivery, and end-user portals.

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Submit or facilitate the submission of spam, malware, or malicious content
• Attempt to circumvent rate limits, API key validation, or domain restrictions
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to collect data from users without their knowledge or consent
• Impersonate another person or entity
• Interfere with or disrupt the Service or its infrastructure

5. API Keys and Widget Embedding

Each project is issued an API key for authenticating widget submissions. You are responsible for keeping your API key confidential. You may configure an allowed-domains list to restrict which websites can submit data through your widget. Submissions from unauthorized domains will be rejected.

6. Data Processing and Privacy

When you embed the Heedb widget on your website, you act as the data controller for the personal data your end-users submit. Heedb acts as a data processor on your behalf. You are responsible for informing your users about data collection and obtaining any required consent under applicable privacy laws (GDPR, CCPA, etc.).

7. AI-Powered Features

Submissions are processed by AI for classification and triage. AI outputs (category, sentiment, summary) are provided on a best-effort basis and may not always be accurate. You should not rely solely on AI classifications for critical business decisions.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to notify you of planned downtime.

9. Rate Limits

The Service enforces rate limits on API requests to ensure fair usage and platform stability. Rate limits vary by plan tier. Exceeding rate limits will result in temporary request rejection (HTTP 429). Persistent abuse may result in account suspension.

10. Intellectual Property

The Heedb platform, including its software, design, and documentation, is owned by Heedb. You retain ownership of all content you submit through the Service. By using the Service, you grant us a limited license to process, store, and transmit your content as necessary to provide the Service.

11. Termination

You may delete your account at any time. We may suspend or terminate your access if you violate these Terms or engage in abusive behavior. Upon termination, your data will be deleted in accordance with our data retention policy.

12. Limitation of Liability

To the maximum extent permitted by law, Heedb shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email to registered account holders at least 30 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
